You must read and agree to
these Terms and Conditions before you can become a member
of PornConverters.com webmaster affiliate program (herein
referred to as "the Program” or “we”. As used in this
agreement, “you” or “your” means the applicant/member/webmaster).
Enrollment:
You must be over 18 years of age (21 years of age in the States
of AL, MS, NE, WY), or over the age of majority if you reside
and/or conduct business in states, provinces or countries
where the age of majority is greater than 18 years of age.
You must be the owner of the website or an individual granted
with the authority to enter into contracts on behalf of the
entity that owns the rights to your website.
Illegal Advertising:
The following terms, along with any derivatives thereof, may
not appear anywhere in the HTML or graphics on your web property:
animal sex, bestiality, Disney, child porn, family sex, incest,
illegal, forced sex, hustler, playboy, penthouse, password
selling or trading, rape, scat or any implied or simulated
terms.
SPAM. Promotion via UNSOLICITED BULK EMAILS
(SPAM) IS STRICTLY FORBIDDEN. Any activity of the kind conducted
by a webmaster, as determined in the sole discretion of PornConverters.com,
will result in the immediate termination of your account and
total forfeit of funds.
Commissions:
The program pays you 50% after refunds and chargebacks have
been deducted. You will be paid 50% for all membership sales,
plus all recurring billing for the duration of each subscription.
If you send over 30 signups per period we will raise your
share to 60% for all membership sales, plus all recurring
billing for the duration of each subscription.
Payouts:
Payouts are calculated based on commissions received during
a month period. Pay Period starts on the 1st and lasts till
the 28/30/31st of the month. All payouts are made in USD and
sent out via Wire Transfer or Epassporte. Should any of the
designated payout days fall on a non- business day, the payout
is postponed until the next business day. Sums below $200
will be rolled over to the next period till you have reached
the minimum payout of $200. First payment is sent 30 days
after the end of the pay period. All payments after the first
payment are sent within 10 days after the end of the period.
If wire transfer is above $1000, the fees are handled by us,
otherwise there is a processing fee of $30.
Account Termination:
The company reserves the right, at its sole discretion, to
pursue all of its legal remedies, including but not limited
to and immediate termination of your privileges granted herein
or deactivation of your account and/or any other services
provided to you by the Company, upon any breach by you of
these Terms and Conditions or if the Company is unable to
verify or authenticate any material you transmit on your website.
The Company reserves the right to terminate any Partner account
for any reason whatsoever. Such reasons that a Partner account
may be terminated for are, but not limited to, cheating, high
chargeback ratios, low- quality traffic, spam, illegal content,
etc.
Fraudulent Activity:
You acknowledge and agree that PornConverters.com shall have
the right, in its sole and exclusive discretion, at any time
to expand or modify what it determines to constitute possible
fraudulent activity. Without limiting the foregoing, possible
fraudulent activity shall include without limitation, the
following circumstances or activities: if there has been an
attempt to process a credit card with a pin number that is
listed in a negative pin number database; and where there
have been sequential or multiple attempts to register or subscribe
from a credit card using the same pin number and sequential
or multiple number strings to complete the credit card number.
Limitation of Liability:
We will not be liable for indirect, special, or consequential
damages, or any loss of revenue, profits, or data, arising
in connection with this Agreement or the Affiliate Program,
even if we have been advised of the possibility of such damages.
Further, our aggregate liability arising with respect to this
Agreement and the Affiliate Program will not exceed the total
commissions paid or payable to you under this Agreement.
Reservation of Rights:
PornConverters.com reserves the right to cancel this program
at any time. PornConverters.com shall not be liable to any
losses due to server downtime, net congestions and any and
all similar and like occurrences or difficulties. All benefit
materials, including but not limited to all advertising banners,
photographic materials, recordings, video, sound, and any
other form of intellectual property provided to you by PornConverters.com
as part of this program shall remain the property of PornConverters.com
and may not be copied, reproduced, altered, modified, changed,
broadcast, distributed, transmitted, disseminated, sold or
offered for sale in any manner except as expressly authorized
in writing by PornConverters.com. Should any law enforcement
agency, internet service provider or other individual or entity
provide PornConverters.com with notice that you have engaged
in the transmission of unsolicited e-mails or have otherwise
engaged in unlawful conduct or conduct in violation of said
service provider's terms of service, PornConverters.com reserves
the right to cooperate in any investigation relating to your
activities, including the disclosure of your account information
in connection therewith.
Miscellaneous:
We may modify any of the terms and conditions contained in
this Agreement, at any time and in our sole discretion. Notice
of any change by e-mail, to your address on our records, or
the posting on our site of a change notice of a new agreement,
is considered sufficient notice for notifying you of a modification
to the terms and conditions of this Agreement. Modifications
may include, but are not limited to, changes in the scope
of available commission fees, commission schedules, payment
procedures, and Affiliate Program rules. All such modifications
shall take effect 48 hours after we serve notice as provided
above, unless indicated otherwise. If any modification is
unacceptable to you, your only option is to terminate this
Agreement. Your continued participation in the Affiliate Program,
following our posting of a change notice or new agreement
on our site, will constitute binding acceptance of the change.
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND
COMPANY. BY SUBMITTING AN APPLICATION FOR ENROLLMENT IN THE
PROGRAM YOU ARE AFFIRMATIVELY STATING THAT YOU HAVE READ AND
UNDERSTOOD THE TERMS AND CONDITIONS. |
